Background The International Criminal Court (ICC) issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Secretary Yoav Gallant, and Hamas military leader Mohammed Deif. This marks the first time a leader of a “western-style” democracy faces such charges.

Why Were the Warrants Issued? The charges stem from events following the Hamas attack on Israel on October 7, 2023, and Israel’s military response in Gaza. The ICC’s three-judge panel cited reasonable grounds to believe that Netanyahu and Gallant are criminally responsible for: – The war crime of starvation as a method of warfare. – Crimes against humanity, including murder, persecution, and inhumane acts. – The war crime of intentionally targeting civilians, as civilian superiors.

Implications The warrants symbolize the ICC’s commitment to addressing alleged war crimes, regardless of political stature. However, enforcement depends on international cooperation, as Israel does not recognize the ICC’s jurisdiction and is unlikely to comply. Arrests would require Netanyahu, Gallant, or Deif to travel to ICC member states willing to detain them. The move could further polarize international opinions on the Israeli-Palestinian conflict and complicate diplomatic relations.
